Heard the learned counsel for the applicant and learned APP for the respondent State.
The petitioner was the complainant in C.C. No. 1184/05. The respondent No. 1 has been convicted for the offence punishable u/s 138 of Negotiable Instruments Act. She has filed an appeal before the appellate Court. The appellate court has suspended the sentence imposed by the trial Court subject to deposit of Rs.3 lakhs as part of the 1/2
8)WP3988.14 compensation awarded by the Magistrate.
In my opinion, it is a discretionary power which has been used by the appellate Court. No interference is called for. However, the hearing of appeal is expedited. Appeal No. 81 shall be decided within a period of 30 days from the date of receipt of this order.
