The petitioner is the owner of property situated at Village Gotane in Ratnagiri District which was acquired for the purpose of Chandoli Abhyaran Project in Ratnagiri. Since the petitioner is residing at Village Danoli, Taluka Shirol in District Kolhapur, he is before us seeking intervention of this Court to direct the respondent authorities to allot the land admeasuring 1 H 15 R in lieu of the land lost by him for the project. Though the respondent authorities were kind enough to allot a portion of 1 H 15 R, to the misfortune of the petitioner during the pendency of the petition the available land identified for the petitioner was allotted to someone else. Thus, the case of the petitioner comes back to the position where it started. ABS

WP 7407-2016 The fact of identifying the land for allotment to the petitioner is not denied by the respondent authorities as could be seen from the averments.

In view of the above, we direct the respondent authorities to consider the writ petition as representation and dispose of the matter strictly in accordance with the procedure contemplated within 3 months from today.
