We find that during the pendency of this Petition, the State of Maharashtra has issued pension payment order in favour of the Petitioner. The grievance of the Petitioner now remains is that the pension has been sanctioned as a "Assistant Teacher" whereas it should have been sanctioned as "Head Master" and the interest for delayed payment of pension has not been paid by the Respondents. 3.
In view of the fact that the Petitioner has extended benefit Vishal Parekar 1/2
39-wp-9971-2012.doc of pension, we dispose of this Petition with liberty to the Petitioner to file a representation before Respondent No. 2 for redressal of his grievances in regard to his claim for delayed pension and pension as per the post of "Head Master".

The Petitioner to submit a representation within four weeks from today before Respondent No. 2. On receipt of the said representation, Respondent No. 2 shall decide the same after giving opportunity of hearing to the Petitioner as also to Respondent No. 6, in accordance with law as expeditiously as possible but not later than three months from the date of receipt of the said representation. 5.
The Petition stands disposed of as such.
