Contention that the cognizance has been taken without previous sanction under section 197 Cr.P.C. can be raised during the trial. The offences registered are under sections 119 and 177 of IPC and sections 3(1)(ii), 3 (3). 3(4), 3(5) and 4 of the MCOC Act. Hence, keeping all contentions of the petitioner open, we dispose of the present writ petition.
