Heard Learned counsel for the applicant and the learned APP at length.

This Court is not inclined to entertain this application. Therefore, the Learned Counsel for the applicant, on instructions seeks leave to withdraw the application.

The application stands dismissed as withdrawn and disposed of accordingly.

Learned Counsel however submits that the applicant has been in custody since 8th November, 2021 and the trial has not yet commenced. Learned Special Judge be directed to make an Talwalkar

The learned APP submitted that charge has been framed. However, no witness has been examined.

In the backdrop of the nature of the accusation and the period of incarceration of the applicant, it may be expedient to request the learned Special Judge to conclude the trial in Special Case No. 68 of 2022 preferably within a period of 9 months from the communication of this order.
