By an order dated 01/10/2016 the applicant was granted interim relief.

It is the allegation against the applicant that the applicant alongwith other accused persons assaulted the complainant. It is categorically stated in the FIR that the applicant assaulted the complainant with a Bamboo stick on her right hand and due to the same the complainant suffered bleeding injury. 3.
I have perused the record of the investigation. Medical certificate issued in favour of the complainant Ratan Ramla Bariya mentions that there are only scratch marks on her right elbow and the said injuries are simple in nature. There is no mention of any bleeding injury in the said injury certificate. It prima facie appears to me that the complainant has made an incorrect statement in the first information report, that due to the assault she has suffered bleeding injury. In view of the above, the applicant has made out a case for his release on pre-arrest bail. The interim relief granted by order dated 01/10/2016 is hereby confirmed. Application is accordingly allowed.

In view of the order passed in ABA No.1708/16, the application for intervention No.882/16 does not survive and is disposed of accordingly.
