By this petition under Article 227 of the Constitution of India, the Petitioner wife challenges the order dated 4.8.2014 passed by Family Court Thane below Exhibit-17 in Petition A-381 of 2011 directing respondent no.2 to pay interim maintenance @ Rs.15,000/- per month for wife and Rs.15,000/- per month for the minor daughter. The learned counsel for the petitioner submits that he received instruction to withdraw the present Writ Petition with liberty to file fresh application for enhanced maintenance in Family Mohite 1/2
36 wp9514-14 Court view of subsequent development. To that effect, he has given in writing on Farad. Same is taken on record and marked 'X' for identification. Same is allowed.
Writ Petition stands disposed of as withdrawn with liberty to file afresh application for enhanced maintenance in Family Court in view of subsequent development and that application be decided by the Family Court on its own merits. Liberty granted to both the parties to file their evidence, if any.
