After hearing this matter for some time, learned counsel for the petitioner, on instructions, seeks leave of the Court to withdraw the petition with liberty to make an application before the appellate authority as provided under Section 45AA of the Employees' State Insurance Act, 1948, seeking interim relief in the matter. Leave with liberty as prayed for, is granted.

We direct that if the application as proposed by the petitioner, is made within a period of two weeks from the date of this order, the same shall be considered and decided by the appellate authority in Aarti Palkar 1/2 906.WP.11352.2023.doc

accordance with law, as expeditiously as possible and preferably within a period of two weeks from the date of filing of the application, after giving re-opportunity of hearing to the petitioner. 3.

All contentions of the parties are kept open. 4.

The petition is disposed of on above terms.
