Mr.Bodake, learned counsel appearing for the petitioner states that since the deed of conveyance is already executed in compliance with the impugned order, his client would file a civil suit for adjudication of title and for other incidental reliefs. Statement is accepted.

Writ petition is dismissed with liberty to file a civil suit for adjudication of the title and other incidental reliefs. If any such suit is filed, the same shall be decided on its own merits. It is made clear that the impugned order does not decide the title in respect of the property in question.

Writ petition is dismissed as withdrawn with liberty as prayed. No order as to costs.
