Heard Mr. Kapadnis, learned APP for the State. 2.

Perused the impugned judgment and order as well as notes of evidence. We find that the injured eye witness has supported the prosecution case. That apart, there are three injured witnesses who have also supported the prosecution case. In the circumstances, we find that arguable points are raised. Therefore, we grant leave to appeal. 3.

The appeal is admitted. The Registry is directed to initiate action against the respondents under Section 390 of the Code of Criminal Procedure, 1973.
