The applicant was issued notice to attend the police station, though not in form of Section 41A of Cr.P.C. Learned A.P.P. makes a categorical statement that it is the applicant, who has participated with the other accused persons and his role has to be ascertained.

Let the Investigating Offcer issue notice to the applicant under Section 41A of Cr.P.c. within three days from today and the applicant shall report to the Investigating Offcer within 7 days from it's receipt.

2/2 915 ABA-2703-22.doc Upon the applicants appearing before the Investigating Offcer, he shall follow the mandate set out under Section 41A of Cr.P.C. and shall record reasons in writing, in case, he comes to the conclusion that the arrest is necessary. Before effecting the arrest for the purpose of custodial interrogation, he shall serve 72 hours notice to the applicant.

With the aforesaid direction, the application stands disposed off.
