Mr.Suryanwanshi, learned counsel for the petitioner on instructions seeks leave to withdraw the petition with liberty to file a discharge application before the trial Court, in case charge-sheet is filed.

In view of this the petition is disposed of as withdrawn with liberty as prayed for. Needless to state that we have not gone into the merits of the matter and all contentions of respective parties are kept open.
