In view of the Affidavits in Reply filed, including an Affidavit in Reply to an Affidavit in Rejoinder, Mr Kulkarni states that only that portion of the land in question spread over for survey numbers, which was being used for cultivation would stand outside the ambit of the Maharashtra Private Forest(Acquisition) Act, 1975. The statement is noted and accepted.

In paragraph 18 of the Petition, it is stated that the Petitioners have moved the Collector Raigad to cancel mutation entry 410. Mr. Kulkarni seeks liberty to pursue that application to the extent of the land under cultivation for agriculture. We grant that liberty and 6th September

18-ASWP-12023-2016.DOC request the Collector to dispose of the application within a period of six months from today.

With these directions, the Writ Petition is disposed of. 4.
