The application is filed for quashing the FIR bearing C.R. No.I205/2014 registered with Nerul Police Station, Navi Mumbai, at the instance of respondent No.3, for the offences punishable under Sections 406 and 420 of the Indina Penal Code, 1860.

By an order dated 3rd November, 2014, this Court issued notice to respondent Nos. 1 to 3 and made it returnable after four weeks. Respondent No.1-State was directed not to file charge-sheet without prior permission of the Court, however, this Court permitted investigation to be carried out.

Mr. Yagnik, learned APP, having taken instructions from the officer concerned who is present before the Court, stated that the investigation into the said FIR is already completed and the police are proposing to file "C" summary report as they found that the dispute which was raised by respondent No.3 is of civil nature. The statement is accepted. In support of the statement, he has placed on record report dated 9th February, 2016 of the Police Inspector (Crime), Nerul Police Station, Navi Mumbai. The same is taken on record. 4.

In the above circumstances, the grievance of the applicant no more survives. The criminal application, accordingly, stands disposed of. 5.
