Heard learned counsel for the parties. This application is preferred by the Respondents for condonation of 76 days' delay in filing the first appeal challenging the judgment and award dated 10/3/2013 passed by the Motor Accident Claims Tribunal, Mumbai in Application No.296 of 2010.

Considering the submissions made by learned counsel for the Applicant and facts disclosed in the civil application, I am satisfied that the Applicant has made out a case for grant of civil Application. Civil Application is allowed in terms of prayer clause (a), which reads thus:

"(a) that this Hon'ble Court be pleased to condone the delay of 76 days in filing the present First Appeal."
