The Applicant apprehending arrest in connection with the investigation of Crime No. 351 of 2021 of Police Station Walchandnagar, Pune under Section 272, 273, 328 read with Section 34 of IPC and Section 26(2)(i), 27(2)(e) read with Section 3(1)(zz)(i), (iii), (iv) and 5 and Section 59 of the Food Safety and Standards Act, 2006, is seeking anticipatory bail. 2.
I have heard the learned counsel for the parties. 3.
The record discloses that interim protection was granted to the Applicant on 30.11.2021 and in pursuance thereof the Sneha Chavan page 1 of 2
20 ABA 2837-21.doc Applicant had attended and co-operated with the investigating agency.

The learned counsel for the Applicant points out that after the receipt of the report of the Analyst a Statutory Appeal has been filed before the Co-Commissioner of Food and Drugs Administration, Pune, which is pending.

The learned APP states that the Analyst had found that the milk was containing Non Food Grade Paraffin, which is in breach of the Provisions of Food Safety and Standards Act, 2006 and Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011. The learned APP states that the investigation is at a concluding stage and therefore, this Court may pass appropriate order.

In such circumstances, the Criminal Application is disposed of in terms of order dated 30.11.2021 subject to the condition that the Applicant shall co-operate with the investigation and shall not tamper with the prosecution evidence/witness. 7.
The Criminal Application is disposed of in the aforesaid terms.
