By this petition, the Petitioner is seeking direction to carry out further investigation in respect of C.R.No. 294 of 2013 registered with Chunabhati Police Station. Prior to the filing of this writ petition, investigation into C.R.No. 294 of 2013 was already completed and A-Summary report was filed on 15th May 2014. The Metropolitan Magistrate by his order dated 21st July 2014 has granted A-Summary. Petition is filed subsequent to the granting of A-Summary report. As on today, there is no crime. Petition for further investigation is, therefore, not maintainable. No need to entertain this writ petition. Hence, it is dismissed.

Needless to mention that if the Petitioner is not heard while granting A-summary report, then, she is at liberty to challenge the order granting A-Summary report. 3.

The observations made herein are for the limited purpose of disposal of this petition. In the event, the Petitioner challenges order granting A-Summary report, same shall be decided on its own merits.
