Heard the learned counsel for the applicant, as well as the learned Additional Public Prosecutor.

Application for suspension of sentence and for releasing the applicant/accused on bail was dismissed in default of the applicant on 18th July 2016. In the instant application, the applicant has mentioned the reasons for seeking condonation of delay for filing the application for restoration, as well as the cause for non-appearance before this Court when the matter was called on 18th July 2016. Hence, for the stated reasons, delay for filing the application for restoration is condoned and the Criminal Application Gaikwad RD 1/2

(12)APPA-1229-16 No.587 of 2016, which was dismissed in default on 18th July 2016 is restored to file.
