This Interim Application is taken out by Respondent No.1 seeking the relief to expedite the matter. 3.

The learned counsel for Respondent No.1 submit that Respondent No.1 is retired from service in year 2016, since N.S. Kamble page 1 of 2

36-ia19541-2022.doc then he has not received gratuity amount. Hence, requested to expedite the hearing of the Petition.

The learned counsel for the Petitioner submit that Respondent No.1 was involved in fraud, the Departmental enquiry was conducted against him and he found guilty, on that basis his gratuity amount is forfeited. He has no objection to expedite the hearing of the Petition.

Considering the submissions of both the parties, the Interim Application is allowed. Hearing of this Petition is expedited.

Writ Petition No.4442 of 2022 be kept on 6 January 2023 'for final hearing'.
