DATED : 12th APRIL, 2022 P.C:- This is the second Bail Application by the applicant; the first one being withdrawn on 9/10/2020 with liberty being granted to move the Court if the trial do not commence within a reasonable period of time. Learned counsel Mr.Vagal has placed on record an order passed by the JMFC, Pune, on 24/11/2021 releasing Accused no.15 Sehbaz Faruk Shaikh on bail, by recording a prima facie case in his favour.

Mr.Vagal would submit that as far as the present applicant is concerned, a miniscule role is attributed to her in the entire charge-sheet, but in the wake of the fact that her husband who is the main accused, is absconding, the prosecution is trying Tilak

2/2 6 BA 4020-21.doc to pin her down. In any case, he seek to derive the benefit of the order passed by the Magistrate recently.

Since this order is passed subsequent to the dismissal of the Bail Application by this Court on 9/10/2020, Mr.Vagal seek permission to withdraw the Application with liberty to approach the JMFC, Pune.

Application is permitted to be withdrawn with liberty as prayed for.

It is clarified that the application has not been entertained by this Court on it's merits.
