Considering the averments made, the Civil Application No.965/2015 is allowed. The petitioners to carry out amendment forthwith.
The petitioners seek to delete the name of respondent no.6. The other respondents have no objection. The name of respondent no.6 is accordingly permitted to be deleted at the risk of the petitioners.
KJ 2/2 wp9774.14-17 Parties have arrived at settlement and considering the interest of all and by keeping all points open, the consent terms marked "X" is taken on record. The advocate for the petitioners and contesting intervenors and advocate for respondent nos.1 to 3 have also signed the consent terms. Even otherwise, after hearing both the parties, the clauses 1 to 4 mentioned in the consent terms are sufficient to dispose of the present writ petition to avoid further delay and dispute in the management/institution.
For the reasons so recorded above and also the clauses so referred, to avoid further complications, it is desirable that respondent nos.4 & 5 not to take any coercive action against Shri Sant Damaji College, Mangalwedha, of petitioner no.1 for not having regular Principal.
The writ petition is accordingly disposed of with liberty. All points kept open. No costs.
