Since the challenge raised in the instant petition is in respect of the notice issued by the Tahsildar and Agriculture Land Tribunal Shahapur calling upon the petitioner to surrender the disputed land, no interference is called for in the instant petition. It would be open for the petitioner to tender explanation to the notice and the concerned authority to take appropriate decision in the matter in accordance with law. If the decision is adverse to the interest of petitioner it would be open for the petitioner to challenge the said adverse decision before the competent authority. It is informed that RTS Appeal preferred at the instance of the original - Page-1/2

Nalawade 920-wp-255-19.doc land owners respondent Nos.8 to 20 is pending before the Sub Divisional OfÏcer, Bhiwandi and the petitioner is also impleaded as party respondent in the said appeal. It would be open for the petitioner to make request to the Sub Divisional OfÏcer for expeditious hearing of the appeal. If the petitioner tenders such request, the said authority shall consider the request favorably and after extending the opportunity of hearing to the parties and in observance of the procedure prescribed under the law, the authority shall decide the pending appeal expeditiously. No further directions needs to be issued in the instant writ petition. The present petition is devoid of any substance and is accordingly disposed off.
