IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.1779 OF 2017 Central Board of Trustees Through Assistant Provident Fund Commissioner-(Legal)...Petitioner vs Tata Business Support Service Ltd.

...Respondent

.....

Mr. Suresh Kumar, for the Petitioner.

Mr. S.C. Naidu, a/w. Mr. Manoj Gujar, i/b. C.R. Naidu & Co., for the Respondent.

......

CORAM : S.C. GUPTE, J.

DATED: AUGUST 14, 2018 P.C:

.

This petition challenges an order passed by the Employees Provident Fund Appellate Tribunal reducing pre-deposit amount covered in the appeal from 75% to 30%. Since this is really a matter of discretion of the Appellate Tribunal, this Court sees no reason to interfere with the order under Articles 226 or 227 of the Constitution of India. The petition is, accordingly, dismissed. It is, however, made clear that the appeal shall be heard and decided by the Appellate Tribunal on its own merits uninfluenced by the present order.
