P.C.:- The Criminal Application No. 461 of 2019 is for releasing the Applicant on bail in the present Revision. Learned APP submitted that, in pursuance of Order dated 21st June, 2019, the Applicant-Accused has been arrested by police on 27th August, 2019 and is at present lodged in Arthur Road Central Prison. The learned counsel for the Applicant submitted that the Applicant has filed Application No. 508 of 2017 for releasing the Applicant on bail.

As noted in Order dated 21st June, 2019, the Applicant had failed to comply with the Order dated 12th March, 2018 passed by this court inter-alia failed to deposit additional amount of compensation of Rs.2 lakhs in the Registry of this Court within stipulated period mentioned therein.

As the Applicant has now been arrested in pursuance of Order passed by this Court, I am inclined to release the Applicant on 2/3

ssm 3 7-20-45-revn517.17.doc bail subject to condition that, the Applicant shall comply with the directions issued by this Court by its Order dated 12th March, 2018 i.e. the Applicant shall deposit the said amount of additional compensation of Rs.2 lakhs in the Registry of this Court before his actual release from Jail.

Hence the following order.

a) The Applicant be released on bail on his furnishing PR Bond of Rs.15,000/- with one or two local sureties in the like amount.

b) The procedure for bail be completed before the Trial Court.

c) It is made clear that, the deposit of the aforesaid amount of Rs.2 lakhs in the Registry of this Court is a condition precedent for the actual release of Applicant from Jail.

d) The Application is allowed in the aforesaid terms. All the concerned to act on the basis of an authenticated copy of this Order.
