Mr.Limaye, learned counsel for the petitioner submits that his client has been already reinstated in the month of March, 2014 by the management pursuant to the impugned order dated 9th January, 2012 passed by the Learned Presiding Officer, Additional School Tribunal, Mumbai.

He submits that the petitioner however, had not been paid the back wages for the period from January, 2012 till March, 2014. He fairly submits that this relief cannot be granted by this Court in this writ petition and seeks liberty to file appropriate proceedings for recovery of the said amount in future.

The writ petition is dismissed as withdrawn with liberty as prayed keeping the issue of back wages for the period from January, 2012 till March, 2014 open. It is made clear that this Court has not expressed any views whether the petitioner would be entitled for the back wages for the period from January, 2012 till March, 2014 or not. If any proceedings are filed for recovery of back wages for the said period, the said proceedings can be considered on its own merits. 4.
No order as to costs.
