The prisoner claimed to be member of the gang and convicted for IPC as also MCOC offence has approached this court for furlough leave. The furlough application has been rejected.

The reason given is that he was released in the year 2013, he did report back, was required to be arrested on 14/2/2015 and therefore, there was delay of 602 days. For this delay, various prison punishments are inflicted upon him. The prison punishments include removal of his name from the remission register, forfeiture of remission etc. The orders imposing these nilegaonkar 1/2

10-appw-456.19-wp-5132.2018.odt punishments are not made available by the prisoner. The nominal roll produced by the learned APP shows that after his arrest on 14/2/2015, he has not been released on furlough or parole at any time.

In this situation, we grant him leave to apply again for leave in accordance with law. If such application is preferred within eight weeks from today, the same shall be looked into in accordance with law within next eight weeks.

Petition is thus disposed of.
