Both sides state that they have arrived at a workable arrangement. They tender consent terms signed by the parties and their Advocates. In these two petitions the challenge is restricted to issue of promotion. Two petitions came to be filed since two lists, one in each petition are subject matter of challenge. Consent terms are filed separately. 1/2

The Consent terms signed by the parties and Advocates are taken on record and marked "X" and "X-1" for identification. Accordingly, I pass the following order :

(i) There will be an order in terms of both the consent terms. One promotional post as provided in clause 2 of the consent terms will be vacant.

(ii) Parties are at liberty to apply to the industrial Court for disposal in view of the consent terms.

(iii) The industrial Court shall fix the matter in accordance with its discretion. Disposal of these petitions shall not influence the outcome of the two complaints.

(iv) Petitions are disposed of in the above terms. (v) Parties to act on an authenticated copy of this order. '
