1) The learned counsel for the applicant submits that investigation is completed and charge-sheet is filed. That there is no iota of evidence against the present applicant. It is also submitted that principal allegations are against son of the applicant and others who were arrested and enlarged on bail. 2) The learned APP submits that offence is registered in the month of January 2016 and till the filing of the charge-sheet the whereabouts of the ism

2/2 33.1713.16 aba applicant were not known despite best efforts. 3) Be that as it may, the learned counsel for the applicant submits that applicant would surrender before the Judicial Magistrate First Class, Madha on or before 24/10/2016.

4) In view of this, applicant stands protected till 5.00 p.m. of 24/10/2016. The learned Magistrate shall make every effort to decide the application on the same day without being influenced by the refusal of grant of pre-arrest bail. Application seeking prearrest bail has not been rejected on merits only on the ground that charge-sheet is filed.
