Pursuant to the order dated 30th August 2019, Dr. Rajiv G. Bhagwat, Consultant Cardiologist, Shushrusha Citizens' Co-operative Hospital Ltd., has given the Certificate dated 3rd September 2019 in a sealed envelope. The said envelope is opened. On a perusal of the said Certificate dated 3rd September 2019, it appears that the applicant had previous history, suggestive of 1/3

myocardial infarction and coronary artery disease. In view of the symptoms, the applicant was advised coronary angiography. From the Certificate, it appears that the patient says that he is willing for the angiography, but keeps on delaying the date for some reason or the other. The Certificate shows that from the treatment point of view, patient can be discharged immediately and can undergo angiography at any other hospital/centre and that he does not need to stay in the hospital, waiting for angiography to be done. The said Certificate is taken on record and marked `X'.

Learned counsel for the applicant states that till date, the applicant has not decided in which hospital he intends to undergo angiography.

Having regard to the Certificate of Dr. Bhagwat of Shushrusha Citizens' Co-operative Hospital Ltd., learned A.P.P to take steps to lodge the applicant back in Arthur Road Jail, on or before 6th September 2019.

Liberty to apply, in the event, the angiography of the applicant is fixed at any hospital or in case of any medical emergency. Application is accordingly disposed of.
