After the hearing of this petition progressed for some time and also after considering the objection as raised by Mr. Palshikar, learned counsel for the respondents that the petitioner has an alternative remedy as provided for under Section 75 of the Employees State Insurance Act, 1948 to approach the Insurance Court, Mr. Balsara, learned counsel for the petitioner seeks leave of the Court, and rightly so, to withdraw this petition with liberty to approach the Insurance Court.

The petition is allowed to be withdrawn with liberty as prayed for. All contentions of the parties are expressly kept open. 3.

Disposed of. No costs.
