Mr. Yogesh Loke, Dy. Director, Directorate of Revenue Intelligence, Mumbai Zonal Unit, is present in court. Mr. Loke, through Mr. Deshmukh assures the court that, on or before 21st October 2022, a detention waiver certificate regarding four containers, which are the subject matter of this petition, will be issued under the Handling of Cargo in Customs Areas Regulation, 2009 and any other relevant provisions to petitioner. Respondent no.2, who is not present, though served, shall accept the detention waiver certificate and release the empty containers to petitioner. Any claim respondent no.2 may have, they will lodge claim with / from respondent no.1. Mr. Deshmukh states that Mr. Loke will inform Ms Mehta, the advocate on record for petitioner, when the certificate is ready and will also email the same to the advocate on record for petitioner. As regards the goods in the containers, it is assured to the court by Mr. Loke, through Mr. Deshmukh, that the four containers in which the alleged contraband goods are stuffed, will be devanned and empty containers will be handed over to petitioner within one week from today. These statements of Mr. Loke, as recorded above are accepted as undertakings to this court.

In view of the above, Mr. Kamat states the petition can be accordingly disposed.
