Issue notice to respondents. Learned APP accepts notice on behalf of respondent - State.

Heard learned counsel for applicant. This application is filed for permission to replace surety furnished by applicant contending that on being ordered to be released on bail, applicant has furnished his surety namely Vishwanath Namdeo More. However, as said surety avk 1/2

14-APPA-1234-2016.doc wants to sell property of which solvency certificate is issued, prays that applicant be allowed to furnish some other surety by discharging Vishwanath More. It is also contended that one Sandeep Doke is ready to stand as surety for applicant.

Record reveals that applicant's sentence came to be suspended by this court by its order dated 27th October 2015 and he is ordered to be released on bail.

Considering facts as aforesaid, applicant Deepak Namdeo More is allowed to substitute his surety, by producing Sandeep Doke as his substituted surety and till the process of acceptance of new surety Sandeep Doke is complete, Vishwanath More shall continue as applicant's surety.
