Heard. This application is filed by wife for dismissal of the Family Court Appeal for non compliance of order dated 25.11.2013 passed by the Family Court, Bandra, Mumbai in Petition No.A-2330/2007.

It is the contention of the Applicant party-in-person that though the Family Court, by order dated 25.11.2013 in Petition No.A-2330/2007 dismissed the Respondent's petition for divorce u/s.13(1)(ia)(ib) of the Hindu Marriage Act, 1955 and directed to pay permanent alimony of Basavraj G. Patil 1/2

11.15-cam.odt Rs.30,000/-p.m. to the Applicant and Rs.15,000/- p.m. to daughter Saraya, the Respondent husband has failed and neglected to pay the said amount. Hence, the appeal be dismissed.

It is to be noted that as the appeal itself has been decided on merits vide judgment of even date, nothing survives in the Civil Application.

Hence, the Civil Application stands dismissed as infructuous.

No order as to costs.
