After this petition was heard for some time and more particularly after being pointed out that the acquisition itself is of the year 1976, in as much as the award is dated 20 March, 1976 when admittedly the Maharashtra Project Affected Persons Rehabilitation Act, 1999 was not in existence, Mr. Nighot, learned counsel for the petitioner would submit that his client intends to file appropriate petition making all averments as to what are the legal rights of the petitioner, if any under the Maharashtra Resettlement of Project Displaced Persons Act, 1976 which was just brought into force at the relevant time i.e. on 11 March, 1977. 2.

We accordingly allow the petitioner to withdraw this petition with liberty to file a fresh petition making all averments in support of any legal right the petitioner intends to canvass.
