The Petitioner challenges the order dated 09.08.2023 passed by learned State Information Commissioner. By the impugned order, the Appeal fled by the Petitioner has been kept on 08.11.2023 at 2.00 p.m. for further hearing. The order also records that the Petitioner sought time to fle written arguments before learned Commissioner and for that purpose, time of 30 days was granted. The impugned order passed by learned Commissioner only grants adjournment to 08.11.2023 and kept the matter for hearing on 08.11.2023 at 2.00 p. m..

It is the contention of Ms. Crasto that the Right to Information Act, 2005 mandates that the Appeal be disposed of within 30 days. However, factual position on record shows that the Petitioner herself sought time for fling written submission and accordingly, time was granted.

Therefore, this is not a case where any interference is warranted under Articles 226 & 227 of the Constitution of India. 5.

Accordingly, the Writ Petition is dismissed, however, with no order as to costs.
