The application is moved for pre arrest bail as the applicant/accused is facing charges for the offences punishable under Sections 420, 465, 468 and 471 read with 34 of the Indian Penal Code in C.R. No. 290 of 2015 registered with Worli police station, Mumbai. The offence is registered at the instance of one Vikas Kale on 5th August, 2014.

It is the case of the prosecution that the sales tax officer has filed complaint that the applicant/accused has created bogus company though there was no actual sales and purchase of the goods 1 / 2
905-aba-1482-2015.doc and on the basis of Hawala invoices sales tax revenue of Rs. 25,71,832/- was evaded. Hence, the offence is registered. 3.
The learned counsel for the applicant/accused submitted that pursuant to the interim order passed on 9th October, 2015, the applicant/accused has deposited the amount of Rs. 5 lacs in the Registry of this Court.

The learned prosecutor oppose the application. 5.
However, considering the facts of the case and as the police have investigated substantially in the matter, the interim pre arrest bail granted to the applicant/accused on 9th October, 2015 is hereby confirmed. The condition of attendance is substituted and modified. Now the applicant/accused shall attend concerned police station as and when called by the investigating officer. 6.
Anticipatory bail application stands disposed of accordingly.
