By the present application, the Applicant/Accused-Mukesh Ramnarayan Gupta seeks extension of one month to furnish the surety as per the order dated 01/02/2021, passed by this Court. 3.
Since the Applicant is not represented, I have perused the application alongwith the order dated 11/01/2021 and the subsequent order dated 01/02/2021, whereby the sentence was suspended and he was directed to be released on bail, subject to M.M.Salgaonkar
2/2 45 IA-3372-22 (5-9).odt the same terms and conditions on which he was released, pending the trial, by the trial Court with fresh bond and sureties. 4.
The application proceed to state that on being released by the Court, as pandemic had grappled the country and, since, he has moved to his native place, he could not comply with the order, but he never had an intention to disobey the same. In the wake of the above, by an application fled on 28/09/2022, period of one month was sought to furnish the sureties in the sum of Rs.16,000/-, since the said amount was fxed by the trial Court.
Though the time was not granted specifcally by an order passed by the Court, but since, the applicant was seeking one month's extension, the period has expired in the month of October, 2022.
In these circumstances, if the sureties are furnished, it should be considered as compliance of the order releasing him on bail or else it shall be construed as a breach and the concerned police station shall take necessary steps for effecting his arrest.
