1. Heard Ms. Antony, learned counsel appearing for the applicant / appellant.
2. Civil Application No.207 of 2020 has been filed by the applicant seeking condonation of delay of 133 days in filing First Appeal. For the reasons mentioned in paragraph Nos.C to E, the delay of 133 days stands condoned. The reasons are cogent and believable and are therefore required to be considered.
3. Ms. Thakre, learned counsel has submitted that the applicant being an educated working lady despite taking advice from Advocate to file the appeal for seeking enhancement against the MACT award, did not take effective steps and delayed filing the Appeal for 133 days.
47.caf.207.20.doc She submitted that one of the reason given by the applicant is that she was ignorant about the legal technicalities of filing the appeal as also limitation. Hence, she submitted that the Civil Application be dismissed.
4. I have considered the rival submissions. The reasons mentioned in the Civil Application are believable and therefore acceptable. Delay of 133 days stands condoned.
5. Civil Application No.207 of 2020 disposed.
6. Ms. Antony is directed to serve a copy of the First Appeal alongwith the copy of the stay application on the respondent / Advocate for the respondent on or before the next date.
7. Applicant to number the First Appeal on or before the next date.
