The learned counsel for the petitioner on instructions states that the petitioner does not want to prosecute the PIL. There is an affidavit in reply filed by the respondent Nos.4 and 5 in which the allegations of extortion have been made against the petitioner. It is an admitted position that based on said allegations, First Information Report has been registered with Ulhasnagar Police Station and investigation is in progress. Only because the investigation through police is going on that we are not ordering any independent inquiry into the said allegations. The investigation by the police shall be taken to its logical conclusion.
Considering the allegations made in the affidavit-in-reply and considering the fact that the
pil245 police investigation is in progress, we permit the petitioner to withdraw the PIL.
However, we make it clear that the issue raised by the petitioner regarding illegal constructions allegedly carried out by the concerned respondents remains open.
Subject to what is observed above, PIL is disposed of.
