Learned A.G.P, on instructions from the respondent No. 3 i. e. the Office of the Additional Commissioner, Pune Division, Pune, states that if the petitioner submits his written submissions on 17th September 2018, the respondent No. 3 will pass appropriate order in the Appeal, on or before 28th September 2018.

In view of the statement made by the learned A.G.P, learned counsel for the petitioner does not press the petition. SQ Pathan 1/2

wp.10290.18.910.doc Accordingly, the petitioner to appear before the Additional Commissioner, Pune Division, Pune on 17th September 2018 at 11.00 a. m. and submit his written submissions. The Additional Commissioner shall, thereafter, pass appropriate orders on the Appeal filed by the petitioner on or before 28th September 2018. Copy of the order shall be supplied by the respondent No. 3 to the petitioner on the date on which the order is pronounced i. e. on or before 28th September 2018. All contentions of the petitioner are kept open. It is made clear, that this petition has not been heard on merits.

In view of the aforesaid, the petition is disposed of, as not pressed.
