Mr. Avachat, learned counsel for the appellant, on instructions, prayed for withdrawal of the appeal. Mr. Avachat submitted that the when the appeal was filed, the investigation was in progress and post filing of the appeal, the investigation concluded in filing charge-sheet. As such, Mr.Avachat submitted the the appellant be allowed to withdraw the appeal with liberty to file appropriate proceedings before the competent Court in view of filing of the charge-sheet so as to avail the remedy as is available under law. At the request of learned counsel for the appellant, the appeal is allowed to be withdrawn with liberty as prayed for. The appeal stands disposed of as withdrawn.
