Learned Counsel for the applicant seeks leave to withdraw the aforesaid application, which seeks quashing and setting aside of the complaint being C.C. No.5408/SS/2016 and quashing of the impugned order dated 26th October 2021. She submits that the applicant be granted liberty to file an appropriate application seeking recall of the order dated 15th November 2021, by which the learned Judge passed an order of 'no cross'. She states that the applicant will file the said application within two weeks before the trial Court.

Application is accordingly disposed of as withdrawn with liberty as prayed.

It is made clear that if an application is filed by the applicant seeking recall of the order dated 15th November 2021, by which the trial Court passed an order of 'no cross' the learned Judge to consider the said application, on its own merits, in accordance with law. 4.
