The petitioner seeks direction to the Collector, Raigad to decide the disqualification application filed by him. It is submitted that the disqualification is sought on the ground of alleged illegal construction by the husband of respondent No.4. Respondent No.4 was elected in the year 2011. The application for disqualification is filed on 13th February 2013. Considering these facts we direct the Collector, Raigad to decide the application for disqualification filed by the petitioner on its own merits. We make it clear that we have not expressed any opinion on the merits of the case. All issues on merits are kept open. 2.
