This is an application for suspension of sentence and releasing the applicant-original accused on bail during pendency of Revision Application filed by him.

Heard learned Counsel appearing for the applicant-original accused. Learned Counsel argues that during the course of trial the applicant was on bail. He has already deposited the find amount and REKHA PRAKASH PATIL therefore, he may be released on bail.

88-a IA-2916-2021.odt Perused the impugned appellate judgment as well as the judgment of the trial Court. It appears that applicant-original accused has been convicted for the offence under Section 3 punishable under section 25 of the Indian Arms Act and has been sentenced to suffer R.I. for one year and fine of Rs.5,000/-, in default, to undergo further rigorous imprisonment for three months. The order of conviction and sentence is confirmed by the appellate Court.

Considering the fact that the applicant-original accused has deposited the fine amount and also the fact that during the trial he was on bail, I pass the following order.

ORDER

(i) The applicant-original accused Sandipkumar Subhashchandra Shah be released on bail on his executing P. R. bond in the sum of Rs.15,000/- on furnishing surety in like amount. (ii) Interim Application stands disposed of accordingly. (V. G. BISHT, J.) Rekha Patil 2/2
