DATED : 18th SEPTEMBER, 2019 P.C:- The applicant has been convicted for offences under the MCOC Act and has been sentenced to undergo RI for a period of five years. He has challenged the conviction by way of Criminal Appeal No.639/2007. The applicant has been admitted to bail by the order dated 7th August 2007.

The applicant is a businessman and seeks permission to travel abroad as also to renew the passport issued to him

2/3 902 APPA 1469-19.doc bearing No.T-0247931. The passport is due to expire on 26th November 2019.

In the past, the applicant was permitted to travel abroad upon the term of depositing ₹ 1,00,000/- by way of security which was liable to be forfeited if the applicant did not return within the time fixed by the Court to return. The applicant has been complying with said terms permitting him to travel abroad.

₹ 1,00,000/- deposited as cash security in the past is still with the Registrar, City Civil and Sessions Court. The applicant wants to travel abroad for business purpose and the countries he seeks to visit are U.A.E, China, Thailand, South Africa, Malaysia and Iraq.

The applicant wanted to leave the shores of India on 10th September 2019 with undertaking to return on 10th December 2019.

In view of the past satisfactory conduct of the applicant, we dispose of the application directing the Registrar, City Civil & Sessions Court to return the passport of the petitioner to him. The applicant would be permitted to seek

3/3 902 APPA 1469-19.doc renewal of the passport for a period of one further year. The applicant would be permitted to leave the shores of India for a period of three months taken from the date he departs from India. The sum of ₹ 1,00,000/- lying with the City Civil and Sessions Court would be treated as security for the applicant to comply with the present order requiring him to return back to India within three months of the date he leaves India. The applicant shall furnish the itinerary of his visit abroad to the Sr. Inspector of Police, Crime Branch, Unit-I, MRA Marg Police Station, Crawford Market, Bombay and shall also intimate his contact number.
