The learned counsel for the Applicant has made a limited prayer stating that there are two accused who are shown to be absconding and the trial may not proceed until these accused are apprehended. He therefore seeks appropriate direction in the matter.

Considering the fact that the case is a custody trial, the learned Special Judge shall take positive steps for apprehension of the accused who are shown to be absconding and if the absconding accused could not be apprehended within a period of three months, the learned Special Judge shall consider taking steps for separation of the trial of these accused and proceed to hold the trial as expeditiously as possible.
