The learned Counsel for the applicant submits that the Second Appeal is pending for admission since 2008. He further submits that 1 / 2

Trupti 1-CAS-176-14.doc the sole appellant -Mahadeo Vithu Mulik expired in the year 2010. However, till today, the legal heirs of the deceased sole appellant are not brought on record.

Under such circumstances, the Second Appeal stands dismissed as abated.
