The above Civil Application is filed seeking condonation of delay of 96 days in filing the above FCA. The reasons therefore are mentioned in paragraph nos. 5 to 8 of the Civil Application. The learned counsel appearing on behalf of the Respondent opposes the application on the ground that no sufficient cause has been made out for condonation of the said delay. Having regard to the reasons set out in the said paragraphs, they can be said to be the plausible reasons for the delay of 96 days occurring in the filing of the FCA. Case for exercise of discretion is therefore made out. ism
