Applicant is seeking regular bail in Crime No. 301/2017 registered with Daund Police Station, Dist. Pune for offence punishable under Sections 302, 201 of the Indian Penal Code. Applicant is arrested on 13/07/2017 and was charge-sheeted. The prosecution case is based on the statements of eye witnesses namely Pravin, Manoj and Sandesh. All these three persons have in detail narrated as to how the incident in question took place.

2 4.2333.18 ba.doc If the statements of these three witnesses are accepted as it is, the only role that could be inferred against the applicant is that of riding a motorcycle while accompanying the accused at the scene of offence who were travelling in four wheeler.

Other than above, there is no specific role of active participation is attributed to the applicant in the crime in question. Applicant is behind the bar for almost more than and and half year. Considering the fact that there is no material directly connecting the applicant to the crime in question, applicant deserves to be released on bail. Hence, following order: (A) Applicant be released in Crime No. 301/2017 registered with Daund Police Station, Dist. Pune, on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

(B) Applicant shall not influence witnesses or tamper with evidence.

Application stands disposed of.
