1) The learned APP submits that investigation is in progress and it would not be appropriate to release the applicant on bail. Upon this, the learned counsel for the applicant, upon instructions seeks liberty to withdraw the application.
2) Liberty as prayed for is granted in the interest of justice with further liberty to approach the Sessions Court under section 439 of the Code of Criminal Procedure, 1973 after filing of the charge-sheet. It is made clear that the present application has not been heard on merits. The learned Sessions Court shall not be influenced by the withdrawal of this application. 3) Application stands disposed of.
